Welcome to Rentmave, a web application developed and operated by MAVA Design EOOD. These Terms and Conditions ("Terms") govern your use of our property management software services ("Services"). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

2. Definitions

Rentmave offers a suite of tools designed to assist property managers in efficiently managing their operations. Our Services include:

• Reservation System (PMS): Manage property reservations and availability.
• Booking Engine: Facilitate direct bookings through customizable interfaces.
• Website Builder: Create and manage property websites with ease.
• Guest Management (CRM): Organize and manage guest information and communications.

4. User Obligations

By using our Services, you agree to:

• Provide accurate and complete information during the registration process.
• Maintain the confidentiality of your account credentials and promptly notify us of any unauthorized use.
• Use the Services in compliance with all applicable laws and regulations.
• Refrain from engaging in any activity that could harm or disrupt the Services or other users.

Prohibited activities include, but are not limited to:

• Unauthorized access or use of our systems or data.
• Transmitting malicious software or harmful code.

5. Subscription and Payment Terms

5.1 Subscription Plans

Rentmave offers three subscription plans:

• Starter: €14.99 per month
• Growth: €39.99 per month
• Premium: €89.99 per month

An annual payment option is available with a 20% discount on the total subscription fee.

5.2 Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis, depending on the selected plan.
• Payments are non-refundable. Due to the nature of our software services, we do not offer refunds for unused services.
• You may upgrade or downgrade your subscription plan at any time. Changes will take effect at the start of the next billing cycle.

5.3 Free Trial

We offer a [duration]-day free trial for new users. To continue using the Services after the trial period, you must subscribe to one of our plans. Failure to subscribe will result in the suspension of your account.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Rentmave shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers and/or any personal data stored therein
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Services

In no event shall Rentmave's aggregate liability for all claims related to the Services exceed the greater of €100 or the total amount paid by you to Rentmave for the Services in the six months preceding the claim.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Bulgaria. Any disputes arising out of or in connection with these Terms shall be resolved through the competent courts of Bulgaria.

12. Third-Party Links and Services

Our Services may contain links to third-party websites or services that are not owned or controlled by Rentmave. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Rentmave shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.

14. Termination

14.1 Termination by User

You may terminate your subscription at any time by providing written notice to support@rentmave.com. Upon termination, your access to the Services will continue until the end of the current billing cycle.

14.2 Termination by Rentmave

Rentmave reserves the right to suspend or terminate your access to the Services with immediate effect if you breach these Terms or engage in activities that may harm the integrity or security of the Services.

14.3 Post-Termination Data Access

Upon termination, your content will become uneditable (read-only) from the last day of paid Services. Your data will be eligible for deletion from our servers following 90 consecutive days after that.

16. Miscellaneous

16.1 Entire Agreement

These Terms constitute the entire agreement between you and Rentmave regarding the use of the Services and supersede all prior agreements and understandings.

16.3 Waiver

The failure of either party to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Rentmave reserves the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that Rentmave shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

21. Indemnification

You agree to indemnify, defend, and hold harmless Rentmave, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Services or your violation of these Terms.

22. Limitation of Liability

24. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without Rentmave's prior written consent. Any attempt by you to assign or transfer these Terms, without such consent, will be null and of no effect. Rentmave may assign or transfer these Terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

25. Notices

25.1 Method of Delivery

All notices or communications required or permitted under these Terms and Conditions shall be in writing and delivered via email. Notices shall be deemed received when successfully sent to the recipient’s designated email address.

25.2 Recipient Addresses

25.3 Changes to Contact Information

Each party is responsible for keeping their email address up to date. Any changes to a designated email address must be communicated in writing via email to the other party.

26. Survival

Certain provisions, including intellectual property rights, warranty disclaimers, indemnity, and limitations of liability, shall survive termination of this agreement.
